Highview Condominium II
MINUTES 12/5/84
8:00 p.m. Unit L-G

Board Members present: Abruzzo, Cooper, Finnerty, Ryan & Simon

1. As the result of our survey/ "rental packets", only one rental agreement has been obtained. We will discuss this situation with Ronald Mazzucca, Esquire, to ascertain how we can go about getting the rest of the agreements from unit owners who have rented their units. We have not received any notices from the survey that Island Condo. Corp. had sent out with the common charge bills as of this time.

2. Angelo Morelli of 6J has notified the Board that he has a leak around the window frame track. Robert Miele also has a leak. We will instruct Karlsen Roofing Co. to inspect the premises and correct these leaks, if possible.

3. Bills reviewed:

*a) $50 snowblowing violation which was paid late by Island Condo. Corp. They never paid the penalties on this and this charge appears on the October statement.
*b) Ronald Mazzucca's bill was discussed. This bill was for written correspondence to/firm Attorney General's office and Mr. Gabbay's lawyer, along with letters sent to delinquent accounts (arrears from delinquent common charges) and correspondence to owners of 5K re: painting their unit from damages caused by leaks.
*c) $92.10 Avco Plumber as the result of their snaking out the "K line" pipes on 11/21/84 as the result of clogged pipes.
*d) Karlsen Roofing Company's check will be mailed for the remainder of balance due on roof/parapet/window work.
*e) Star Boiler will be paid $552 for work done including the check valve which was repaired.
*f) Huntsdorfer will be paid $645.00 for plumbing work to repair damages caused by leaks in E & F line. There was also another leak in 3G/4G line but 3G repaired damages themselves with no bill sent to the Condominium.
*g) A $150.00 bill for the valve in laundry room to be replaced causing leaks there will be paid.
h) Hardwick Electric Company has been to visit the premises to replace the cable in the elevator. We have not obtained this bill to date.
i) BUG has sent us out a final disconnect notice for the period of 10/26/84 thru 11/27/84. Supposedly, Island Condo. Corp had paid this bill on 11/30/84. (Out of $3,655 owed to BUG, $1,000 was previously paid, and this payment was $2,632 to pay for penalties and remainder of the bill.) We also noted that on the 11/84 statement from Island Condo. Corp, check #313 for $220.00 was sent to BUG and we question what this was for. Martha will contact BUG and ascertain what we owe and what these bills are.

* These bills have been sent to us with checks from Island Condo. Corp. as Martin Filler did not know what they were for and would check with us before sending them out.

A discussion was brought up re: penalties and who pays them--should Carlos pay for any violations as the result of his actions, should Island Condo. Corp. pay for any penalties which might incur as the result of sending out checks later. etc...

Martha Simon made a proposal that Highview Condo. II should not pay any penalties, rather anyone who is responsible for the delinquencies should pay the bill.

4. A check in the amount of $1,800 was sent to us from the Insurance Company for payment of work done/to be done caused by leak in J line. However, the check was made out in the names of H.C. II and Elia Kalimean who is no longer affiliated with H.C.II. Martha contacted the insurance company and was notified that they had obtained Mr. Kalimean's name from the original insurance company, Fireman's Fund. Furthermore, Manhattan Hanover's Trust Company holds the mortgage, not Mr. Kalimean. Martha then wrote them a letter and returned the check. The Insurance Company contacted Martha that they will re-issue a corrected check.

5. Martha Simon suggested that all bills should be sent to our P.O. Box or to the Condominium for review by the Board and then given to Martin Filler for payment. Dorothy Simon would be able to stop by the Post Office every other week for the incoming mail.

The consensus was that we allow the billing to go along as it is at the present time until a new managing agent has been hired.

6. Managing Agents:

a) Bartels & Eleford, Inc. will not be available for managing agent's work until 4/1/85 as they are not on a computerized schedule as of yet but will be 4/1/85. They charge $8/unit but we will contact them and see if they can visit the premises and speak with us in January and we will then decide whether or not to hire them effective April of 1985.
b) C.M.S. Company has sent us a proposal only. We will contact them to send us a contract.
c) Grenadier Company will not be used as they are too expensive and some of their services will not be needed by us.
d) Century 21 will not be used as they are too expensive.
e) Serkez and Associates Realty Company will not be used.

We will arrange for two companies to visit the premises and discuss with them their procedures. The next meeting with the new perspective agents will by Monday, 1/14/85.

7. We have been advised that Chemlawn has been submitting bills to us with commercial rates. We should get the bills changed to "homeowner rates" as it is not as expensive. (This is another item that our present managing agent did not pick up.)

8. Carlos will be performing painting and plastering work to those units which were effected by the leaks. He will receive straight wages for this--a flat fee for each unit done, with taxes taken out.

The walls have been repaired in Unit 6G caused by leaks from the roof. (We should be reimbursed by Mr. Gabbay as this was included in the original "Packet.")

9. We will consult with Carlos to see if he will be available to clean windows in the building for those tenants wishing to utilize his services. He will do it on one day (or more, if there are more people requesting their windows to be done) and will have an established rate per window.

10. We have been sent a letter from Ronald Mazzucca re: Sponsor's attorneys response to our previous correspondence. A copy of this will be found in the files (dated 12/3/84) and copies distributed to each Board member.

Ronald Mazzucca wants to come to a Board meeting and discuss this issue (along with the rental packet).

We have decided that if by the end of January, 1985 the Attorney General still does not have this resolved, we shall then decide whether or not to adopt other measures.

We shall also include in this "packet" all those information, letters, etc. not contained in this "packet" (leaks originally sent to Mr. Gabbay in the original "Packet", etc.

We will instruct Ronald Mazzucca to write a letter to Ollie Rosengart (with one copy to Robert Abrams, Attorney General) to inquire what is taking so long.

11. The issue of the residents living in Carlos' unit was addressed. Carlos should be the only one doing the work in the building (not his brother, etc). We will have Martin Filler contact Carlos and discuss the inhabitants of his unit - who they are, how many are living there, they are not recognizable to other residents in the building, etc. We will also inform Martin Filler that we shall only pay Carlos' electric bill up to $50.00 and the remainder will be paid by Carlos.

12. We will obtain three bids on carpet cleaning companies and Tom will obtain a price on renting a machine to clear/deodorize the carpets. This will be done before the holidays.

13. We will have a Tree Trimming party on Tuesday, 12/18/84 at 8:30 p.m. in the lobby for all residents. Tom will buy the tree and we shall also serve wine (red and white) with potato chips and pretzels.

We shall purchase two sets of colored lights for the tree and a white Hanukah tablecloth.

Martha Simon will type up the memo and distribute it on 12/17/84.

14. Once again we are having problems with the garbage problems in the compactor hallway. Martha Simon will compose a memo and attach to it a trash bag and will leave it outside of the door of the offending party. She will also compose a general memo reminding residents not to dispose of any bulky items or newspapers down the compactor room, rather, dispose of it in the bin located in compactor hallway.

15. The next meeting will be held on Monday, 1/14/85.
